Now, you may ask, why this, why now? Isn’t marriage for same sex couples protected at the national level? The answer is yes, for now. But we know based on recent precedent with the overturning of Roe v. Wade that this U.S. Supreme Court is one bad decision away from overturning Obergefell v. Hodges which made marriage equality the law of the land. If that happens, the 2006 ban would go into effect in Colorado (along with 30 other states that also have bans on the books!), and marriage for LGBTQ+ couples would immediately be at risk. We have to take action now to remove the ban and ensure protections for our communities. 

U.S. Supreme Court Justices Clarence Thomas and Samuel Alito have recently signaled they would be in favor of revisiting Obergefell v. Hodges. Justice Thomas said that “the same rationale that the Supreme Court used to declare there was no right to abortion... should also be used to overturn cases establishing rights to contraception, same-sex consensual relations and same-sex marriage.”

If LGBTQ+ couples lose the right to marry, they will also lose benefits like hospital visitation rights, access to healthcare coverage, and social security and tax benefits. In this country, individuals have the right to life, liberty, and the pursuit of happiness. The government should not get to decide whether two consenting adults can marry, and they do not have the right to ban people from deciding how to live their lives.

Ahora, te puedes preguntar, ¿por qué esto, por qué ahora? ¿No está el matrimonio entre personas del mismo sexo protegido a nivel nacional? La respuesta es sí, por ahora. Voters must take action before November 5, 2024 to vote YES on Amendment J. The question will be, “Shall there be an amendment to the Colorado constitution to remove the ban on same sex marriage?”

This measure will remove the “legal” definition of marriage as between one man and one woman thereby clearing the way for protections for marriage for same-sex couples in Colorado.

The Freedom to Marry Colorado campaign is led by One Colorado, Rose Community Foundation, Rocky Mountain Equality, and other leaders and allies in the LGBTQ+ community. They worked in partnership with Freedom to Marry Colorado Coalition and legislators to successfully pass a referred measure during the 2024 Legislative Session that refers Amendment J to the 2024 ballot and are bringing this home in November.

In 2015, the U.S. Supreme Court held in a 5–4 decision through Obergefell vs. Hodges that the Fourteenth Amendment requires all states to grant marriage for same-sex couples and recognize those granted in other states. There has been a lot of speculation that with a more conservative court, this decision could be overturned. We’re working to #RemoveTheBan from the Colorado constitution to ensure equal marriage rights to Coloradans regardless of Supreme Court action.

En el 2015, la Corte Suprema de los Estados Unidos dictaminó, en una decisión de 5–4 en el caso Obergefell vs. Hodges, que la Decimocuarta Enmienda requiere que todos los estados otorguen el derecho al matrimonio a las parejas del mismo sexo y reconozcan los matrimonios realizados en otros estados.
